Terms & Conditions

Please read this page carefully before applying to or engaging with Built to Run Consulting. By submitting an application or entering into any services agreement, you acknowledge and agree to these terms.

These terms apply to all Built to Run Consulting engagements
The Integrator Program — 6-week operational system design and installation
Fractional Integrator Retainer — ongoing embedded operational support on a month-to-month basis
1:1 Visionary Consulting — direct, session-based advisory with flexible scope and no fixed deliverables

Where a term applies differently across engagement types, this is noted within the relevant section. When terms are not engagement-specific, they apply uniformly to all three.

Section 01

Client Responsibility Disclaimer

All Built to Run Consulting engagements are service-based, not outcome-based. Built to Run Consulting is responsible for delivering the agreed scope of work — whether that is designing and installing operational systems, providing ongoing embedded support, or offering direct advisory — with skill, care, and professional judgment. The client is responsible for the decisions made, the direction given, and the execution that follows.

The success of any work delivered under a Built to Run Consulting engagement depends on the client's commitment to participation, implementation, and follow-through. Built to Run Consulting does not manage your team, own your decisions, or guarantee that frameworks, systems, or guidance provided will be adopted correctly or consistently after the engagement or session concludes.

In plain terms: We bring the expertise and do the work. What you do with it is yours. Responsibility for execution stays with you and your team.

Timeline & Engagement Structure

Each engagement type carries its own timeline expectations. These are targets and structures — not guarantees — and are subject to variation based on client availability, responsiveness, business complexity, and other factors outside Built to Run Consulting's control.

The Integrator Program targets a 6-week installation window. This is a goal, not a contractual deadline. Delays caused by client-side factors — including scheduling conflicts, postponed sessions, slow feedback cycles, or incomplete team participation — may extend the engagement. No refunds or fee adjustments will be issued where client-side delays contributed to a timeline extension.

Fractional Integrator Retainer engagements operate on a month-to-month basis. Either party may discontinue the retainer with written notice as agreed upon at the time of engagement. Ongoing scope is reviewed and confirmed at the start of each engagement period. Built to Run Consulting is not responsible for operational gaps that arise from the client's failure to communicate shifting needs or priorities.

1:1 Visionary Consulting sessions are scheduled on a flexible, session-based basis. There is no fixed timeline or delivery commitment associated with this engagement type. Sessions are scheduled by mutual agreement and do not carry over, accumulate, or guarantee future availability unless otherwise agreed in writing.

In plain terms: Timelines depend on the engagement. The Integrator Program has a 6-week target. The retainer is month-to-month. Advisory sessions are scheduled as needed. In all cases, your availability and responsiveness directly affect what gets done and when.

Team Cooperation Clause

Engagements that touch operational systems — particularly The Integrator Program and the Fractional Integrator Retainer — require meaningful access to and cooperation from the client's leadership team. These engagements work at the level of operations, team structure, meeting rhythms, accountability systems, and execution workflows. For the work to hold, the relevant members of the client's team must be available, engaged, and willing to participate in the process.

By entering into an engagement, the client confirms that they have the authority and practical ability to secure their team's participation. Built to Run Consulting is not responsible for outcomes where team members refuse to engage with, adopt, or maintain the systems designed or managed during the engagement. Operational infrastructure cannot be forced to function by an outside party — it requires internal ownership.

For 1:1 Visionary Consulting, this clause applies to the extent that the value of any session depends on the client's honest engagement, preparation, and follow-through on any direction or discussion that takes place.

In plain terms: We need real access and real buy-in to do real work. If the team won't show up or won't execute, the engagement can't deliver what it's designed to deliver.
Section 04

Scope Limitation

The scope of each Built to Run Consulting engagement is specific to the engagement type and confirmed during the discovery and onboarding process. Scope is not open-ended and does not automatically expand beyond what has been agreed in writing.

The Integrator Program scope includes: operational system design, documentation, and installation; meeting and accountability structure; role clarity and delegation frameworks; performance visibility tooling; and 90-day execution planning — as agreed during the discovery call. It does not include ongoing coaching, fractional support, or implementation management after the 6-week installation window.

Fractional Integrator Retainer scope is defined at the start of each engagement period and may include embedded operational support, systems management, team accountability, and coordination across functions — as mutually agreed. It does not include legal, financial, or HR advice; hiring or managing personnel; or any work outside the agreed operational scope.

1:1 Visionary Consulting scope is flexible and session-based. There are no fixed deliverables. Advisory conversations may touch strategy, operations, organizational structure, priorities, or other topics at the client's direction. No specific output, document, plan, or framework is guaranteed as a result of any session.

Across all engagements, scope does not include: legal, financial, tax, or investment advice; real estate deal sourcing, underwriting, or transaction management; technology development or software implementation outside of explicitly agreed tools; or any services not confirmed in writing prior to the engagement.

Requests outside of the defined scope require a separate agreement and may incur additional fees. Built to Run Consulting reserves the right to decline out-of-scope requests.

In plain terms: Scope is defined per engagement and confirmed before we start. Anything outside that scope is a separate conversation. We don't advise on deals, legal, or finance — regardless of the engagement type.
Section 05

No Guarantee of Results

Built to Run Consulting brings real experience, structured methodology, and genuine investment to every engagement. However, we cannot and do not guarantee specific outcomes of any kind — across any engagement type. This includes, without limitation: revenue growth, profit improvement, team performance, owner time reduction, business scalability, deal outcomes, strategic clarity, or any other operational or financial metric.

Business results depend on a wide range of variables outside our control, including market conditions, team capability, owner decision-making, capital availability, economic environment, and execution consistency. The systems we design, the operational support we provide, and the conversations we facilitate create conditions for improvement — they do not produce improvement automatically.

Any case studies, testimonials, or examples shared on this website or in our marketing materials reflect the experiences of individual clients and are not a representation that you will achieve the same or similar results.

In plain terms: We do our best work on every engagement. But results are created by execution — and execution is yours. We can't guarantee what we don't control.
Section 06

Limitation of Liability

Our liability for any Built to Run Consulting engagement is limited to the fees paid for the services rendered under that engagement. In no event shall Built to Run Consulting, its principals, contractors, or affiliates be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services provided, regardless of the form of action and whether in contract, tort, or otherwise.

This limitation applies across all engagement types — The Integrator Program, Fractional Integrator Retainer, and 1:1 Visionary Consulting — and covers, without limitation: lost profits or revenue, lost business opportunities, operational disruptions, team performance outcomes, damages arising from reliance on systems, frameworks, or guidance provided, or any damages that result from the actions, decisions, or inactions of the client or their team during or following the engagement.

By submitting an application and entering into any services agreement with Built to Run Consulting, you agree to this limitation of liability. If you do not agree, do not submit an application or execute a services agreement.

In plain terms: Our liability caps at what you paid us for that specific engagement — nothing more. We're not responsible for downstream decisions, business losses, or outcomes outside the work we delivered.
